Business Creative Designs Website Development Terms and Conditions

Business Creative Designs provides products, software, and labor services (hereinafter referred to as “Services”) subject to the client’s or buyer’s (hereinafter referred to as “Client”) acceptance of and compliance with the Terms and Conditions (hereinafter referred to as “Terms”) and the Service Level Assurance Agreement (hereinafter referred to as “SLA”) outlined below:

The Terms of the Agreement will begin on the date the Client registers for our Services and will continue until terminated by either party in accordance with the Terms and SLA. Business Creative Designs has the authority to use its identifying mark, which may be a logo, design, URL, or any kind of brand identity, on all websites/products delivered, and this comes into effect without the client’s consent.

Business Creative Designs may provide the Client with one or more of the following services depending on the selected service package: business website, business-related web pages, storage, domain-based email services, website hosting, or support. Unless otherwise stated, any new feature that enhances the services will be considered part of the Services. Business Creative Designs reserves the right to modify, suspend, or terminate the Services (or any part thereof) due to non-cooperation, non-payment, or undue delay from the client at any time without notice. The Client expressly agrees that neither the Client nor any related third party will hold Business Creative Designs or its suppliers liable for any losses or damages resulting from such changes.

To access Business Creative Designs Services or websites, the Client may be asked to provide certain registration details or information. It is a condition of use that all the information provided is correct, current, and complete. If Business Creative Designs believes the information is incorrect, it reserves the right to refuse access and to terminate or suspend the Client’s account. All calls may be recorded for training and quality purposes.

Business Creative Designs is committed to offering technical help on all delivered projects for a maximum of one month (30 days, including weekends and public holidays) from the date of delivery or go-live. This clause does not apply to projects not hosted by us, as we cannot support changes made by other providers. Any issues after this period will be supported at a cost, determined case by case. “Technical Support” includes only bug fixing, troubleshooting, technical advice, and minor site changes. It does not include major structural, functional, or design changes.

Business Creative Designs reserves the right to cancel any domain/hosting service on its servers with a maximum notice period of seven days before expiry. Notification will be given via postal mail, hand delivery, fax, email, or phone call. Clients are responsible for renewing services at least seven days before expiry. Failure to comply releases Business Creative Designs from any obligation to keep the hosting active beyond that period.

For domain and/or hosting transfers, the process is as follows: Business Creative Designs Accounts Team will confirm any dues or provide clearance within 3 working days. Once dues are cleared, the team will provide the EPP/Auth Code and unlock the domain. The client must then initiate the transfer request with their new provider and inform Business Creative Designs at info@businesscreativedesigns.com. After approval from Business Creative Designs, the transfer usually completes within 5 calendar days. The Auth Code is valid for a limited time only; if unused within 5 days, a new request must be submitted.

Clients agree to pay the service fee according to their selected Payment Plan, including all applicable taxes, per the billing terms in effect. Clients authorize Business Creative Designs to automatically charge their card or bank account either monthly or once, based on the program. Business Creative Designs reserves the right to pursue alternate payment methods including debt collection, and clients will be responsible for all related costs.

Because Business Creative Designs provides bill-through service for sponsored listings, it bears significant credit risk. Therefore, the Client must maintain an active, valid payment method on file at all times. If the payment method fails, Business Creative Designs may suspend all services, including the website, advertisements, and reporting tools. If payment is not received, Business Creative Designs reserves the right to terminate the agreement and retain ownership of the website, domain, or services until the account is settled. Early termination will accelerate all remaining payments under the agreement. Clients are encouraged to maintain multiple payment methods to avoid disruption.

Business Creative Designs, as a merchant, holds no responsibility for any direct or indirect loss or damage arising from transaction authorization declines due to the cardholder exceeding credit limits or other banking issues.

Clients represent and warrant that they have sufficient authority to enter into the Agreement, are using the services for legal business purposes, and have the rights to provide all necessary data.
